thanks. That's a lot of manipulation to both songs to make them sound similar IMO. I think the phrasing/melody is similar but overall I think they sound different enough that Sam shouldn't have had to pay royalties to Petty. I agree- I've heard far more egregious similarities in many other songs. Especially the one Cheeks referenced
The link to the article posted few pages back said that they've settled out of court and they settled it quickly. So maybe they realized the similarity too otherwise they would go to court to prove it wrong. And the press would not do good for Sam and his team.

The "Somebody to Love" video from kinkykiedis is now blocked by Believe Music for copyright infringement. It did not seem that any of the others on her playlist were blocked but Believe Music could be out scouring YouTube and looking for others to block. If there is a video you are particularly fond of, may want to download until it all gets sorted out again like it did from the US tour videos. I won't have time to sort through everything so hope they don't do wholesale blocking today.

Just received an email from Magazine Cafe that the copy of the Classic Rock magazine is processing but delayed due to the snowstorm that is expected to hit the NE later today. Hope I get it in good condition sometime soon. Ordered it weeks ago.

Someone put together a mashup of the two: I don't necessarily think that Sam Smith intentionally plagiarized Tom Petty's song. But, put side by side and modified to match tempos and keys, and they are so close to identical that the slight differences in melody are less than the differences when Adam changes up the same song in different performances. Paul McCartney has said that he woke up one day with "Yesterday" in his head, almost fully composed. It came so smoothly that he thought it was a song he had heard before. He actually went around playing it for people and asking if they had heard it. I think probably Sam Smith was just the opposite. He had heard the Tom Petty song sometime in the past, and as he was writing, the chord progression morphed into the identical melody line as well. Many songs have similar chord progressions, so that in itself would not be plagiarism. This, while not automatically assumed to be "stolen", was definitely "influenced by." Another Beatle had a similar problem. George Harrison was successfully sued by Bright Tunes, the music corporation that owned The Chiffons' hit "He's So Fine," because Harrison's song, "My Sweet Lord," shares so many of the same chords and melody patterns. The judge called it "subconscious plagiarism" but still decided the case in favor of Bright Tunes.
